07/09/2012 - A New Jersey jury took six hours to find that Roche failed to warn consumers of the risks of bowel disease associated with Accutane use according to Bloomberg News. [1] $18 million dollars was awarded to two plaintiffs who accused the drug maker of being responsible for their bowel disease.
Roche has now lost 9 of 13 cases pertaining to failure to warn of serious side effects of their Accutane drug. Over 16 million people have taken the drug since its 1982 release. Roche still maintains that they did not fail to properly warn consumers of the bowel risks and is appealing all of the awards to plaintiffs. “The company believes that the evidence at trial demonstrated that Accutane did not cause this disease and that Roche acted appropriately in providing information to the medical, scientific and regulatory communities,” Chris Vancheri, a U.S.-based spokesman for Roche, said in an e-mailed statement.
