Essure Lawsuits Against Bayer on the Rise

There has been a significant increase in the number of Essure lawsuits filed against Bayer in the last few months. As of January 30, 2018, approximately 16,100 lawsuits have been filed by Essure victims, seeking both compensatory and punitive damages against Bayer. Women who were injured by Essure and who have not yet filed their claims, are urged to do so quickly as various time limitations are applicable and are approaching.

Ennis & Ennis, P.A. and co-counsel have filed dozens of Essure lawsuits, representing thousands of plaintiffs, against pharmaceutical giant, Bayer and several related subsidiaries. The significant complications suffered by these plaintiffs include migration, hysterectomy, abdominal pain, pelvic pain, back pain, bloating, weight gain, mental haziness, heavy menstrual bleeding, irregular menstrual cycles, perforated organs, autoimmune issues, hair loss, tooth loss, headaches, pregnancy and other complications. 

The Essure device is a four-centimeter coil placed into each fallopian tube to prevent pregnancy by causing severe inflammation creating a total blockage of the fallopian tubes.The coil also contains polyethylene (PET) fibers, which irritate and inflame the tubes, causing scar tissue to form over the coils, blocking subsequent fertilization. Unfortunately the PET fibers which create the irritation to form the scar tissue, often cause the body to fight what it deems to be an infection or foreign body, creating a host of other problems from autoimmune disorders, neurological problems, kidney, adrenal and thyroid disorders and even cancer. The coils often become dislodged, perforating the fallopian tubes, uterus, colon or other internal organs.

Holly Ennis, one of the attorneys filing the complaints stated, “We will continue to file lawsuits and to vigorously fight for every woman injured by Essure to be compensated by Bayer. We also seek legislative changes through the Medical Device Safety Act 2017, and will continue to pressure the FDA to suspend Essure's PMA, pending the outcome of the current clinical trials, despite Commissioner Gottlieb’s current reluctance to do so.”

Essure lawsuits have been filed throughout the country. There are over 13,000 cases pending before the Honorable Winifred Smith in California. There are also three thousand lawsuits pending between Philadelphia, St. Louis, Illinois and New Mexico. Most cases are currently in the discovery phase of the litigation with plaintiffs filling out Plaintiff Fact Sheets. Plaintiffs’ counsel is focused on reviewing documents produced by Bayer and taking depositions of key Bayer personnel, despite Bayer’s attempts to stall and delay at every opportunity. Essure has been discontinued or withdrawn world-wide with the exception of the United States. However, as sales are clearly declining, it is not anticipated to be on the market for much longer. In fact, Essure is no longer listed as a product on Bayer’s website.
