Boston Scientific ordered to pay $431M in stent patent trial

02/12/2008 -The jury in a patent infringement trial has ruled against Boston Scientific Corp., awarding the plaintiff Bruce Saffran $431 million, according to officials of the life sciences company.

Saffran brought suit in December 2005 against Boston Scientific in U.S. District Court jury in Marshall, Texas, claiming that the Boston Scientific's Taxus Express and Taxus Liberte drug-eluting coronary stents infringe on his patent. The jury found that the patent is valid. Saffran did not request any injunction preventing Boston Scientific from selling the two Taxus stents, according to the Natick-based life sciences company.

Boston Scientific said it believes the jury verdict is unsupported by both the evidence and the law, and plans to seek to overturn the verdict in post-trial motions before the District Court. If that doesn't work, the company reports plans to appeal to the U.S. Court of Appeals for the Federal Circuit.

Saffran requested the jury trial. Opening arguments were delivered on Feb. 4, and the jury began deliberations after closing arguments yesterday.

Late last year, Boston Scientific garnered approval of its Taxus coronary stent in Europe for patients with diabetes. Officials of the life sciences company said at the time that the European approval expanded its Taxus product for more uses than any other drug-eluting stent on the market. Stents are devices used to prop open arteries for patients with coronary artery disease.

Boston Scientific reported a 2006 net loss of $3.6 million on sales of $7.8 billion. The company lists 28,600 workers.
