Claimants Should Not Delay Filing DePuy ASR Hip Recall Claims

08/30/2012 - Claimants having a potential lawsuit against Johnson & Johnson (J&J) for a defective DePuy hip implant should not delay in getting their claims filed. J& J may take the position that a two-year statute of limitations period or time within which to file a claim expired on August 26, 2012, two years after the date of the recall. To date, no judges have ordered a halt and statute of limitations periods vary from state to state. However, DePuy’s attorneys may argue for a universal two-year statute of limitations, cutting off any future claims.
The statute of limitations period for each DePuy ASR hip recall should depend on the state the claim is filed, where the initial and possible subsequent surgery took place and the circumstances surrounding the injury. However, approximately half of the states have a two-year statute of limitations period, which may prevent future filings depending on the date of surgery.
