01/10/2013 - Depuy ASR Hip Recall lawsuits are moving forward in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Ohio. The next Status Conference in the federal DePuy ASR hip recall litigation is scheduled for today at 11:00 a.m. Depuy Orthopaedics is facing more that 6,000 claims involving its ASR hip replacement devices. These products were recalled in August 2010 after the FDA determined the devices had unacceptably high failure rates. The first trial is set to begin on May 6, 2013 with a second trial following on July 8, 2013. (In re: Depuy Ortopaedics, Inc. ASR Hip Implant Products Liability Litigation-MDL 2197).
Other suits are sure to follow. The FDA is currently reviewing other meta-on-metal hip implants due to safety concerns that metal particles shed by the devices can damage surrounding tissue causing a host of medical issues. Depuy is also involved in a second multidistrict litigation in the U.S. District Court for the Northern District of Texas regarding its Pinnacle Hip Replacement System. There are about 140,000 Depuy Pinnacle metal-on-metal hip implants implanted in US citizens between 2002 and 2011 according to the New York Times. 1
Accordingly, all recipients of these and other metal hip devices need to get a blood test to test the levels of chromium and cobalt in the blood to determine if the devices have failed. These bellwether trials are important as they help guage how juries might rule in other similar actions.
