Johnson & Johnson Settles DePuy ASR Hip Cases for $600,000

08/21/2012 - Plaintiffs who allegedly sustained injuries from DePuy ASR hip implants resolved their claims against DePuy Orthopaedics, the manufacturer and distributor of the subject implants, for about $600,000 reports Bloomberg. [1] The lawsuit involved three plaintiffs, ages 74, 69 and 60, so they each averaged $200,000 to resolve the claim before they were scheduled to begin trial the first week of December. The lawsuit alleged injuries including health problems associated with metal filings and evidence of bone damage from the metal hip devices. [2]
In August 2010 DePuy recalled 37,000 ASR devices within the US due to high rate of revision surgeries required to correct or remove the defective implants. [3] Meanwhile, there are more than 8,000 lawsuits currently pending.
Eric Gordon, a business professor at University of Michigan, commented that the settlements were “at the low end of what the company should have expected”, according to Bloomberg. He felt the settlements should have been in the $200,000-$500,000 per case range.
“Without knowing the specific facts of each case it is difficult to say whether the settlements were fair and reasonable. What concerns me is there are too many victims who have not explored their legal rights. If you do nothing, then you get nothing and J&J wins. They bank on slow settlements and the running of the statute of limitations so they get ‘off the hook’,” commented Attorney David Ennis with Ennis & Ennis, P.A.
