Merck Settles Fosamax Jaw Decay Lawsuit while Femur Fracture Cases Continue to Mount

10/19/2012 - Fosamax femur fracture and Fosamax osteonecrosis of the jaw lawsuits filed in New Jersey Superior Court are scheduled for a Case Management Conference on November 9, 2012 before The Honorable Carol E. Higbee.  [1]

Fosamax was FDA approved in 1995 to treat osteoporosis in postmenopausal women and Paget’s disease of the bone and then later approved for osteopenia, a pre-osteoporosis condition.  

Fosamax, with the active ingredient bisphosphonates, is the subjects of hundreds of lawsuits wherein plaintiffs allege that the manufacturer, Merck & Co., failed to warn of the risk of atypical femur fractures (uncommon breaks of the thigh bone) and osteonecrosis of the jaw (death of the jaw bone) caused by drug.

In 2004 studies confirmed a link between Fosamax and osteonecrosis of the jaw, but it wasn’t until July 2005 that Merck changed the label to warn of the ONJ risk.  

Prior studies also revealed a link between the use of Fosamax and atypical femur fractures.  In fact, in 2008, the U.S. Food and Drug Administration (FDA) issued a warning to consumers and health professionals regarding the atypical femur fracture risk, but it wasn’t until 2010, that Merck finally added the warning of  atypical femur fracture risks.

In September 2011 an FDA advisory panel met to discuss the risks associated with Fosamax and reported that studies revealed that there wasn’t any benefit in taking the medication beyond three to five years.   This sparked such concern that some physicians are recommending to their patients to stop taking Fosamax after a period of three to five years.
