Judge Denies Merck’s Motions During Second Fosamax Femur Fracture Lawsuit

04/15/2013 - The judge in the second Fosamax femur fracture trial made several important rulings, which could have important implications in the outcome of the trial. According to a Law 360 article published on April 11, 2013, Judge Joel Pisano rejected Merck’s attempt to block the testimony of eight doctors for the Plaintiff and rejected Merck’s argument that four of Plaintiff’s expert witness were not qualified to testify about the femur fractures being related to Fosamax.

09/27/2012 - After extensive litigation, Merck, the manufacturer of the osteoporosis drug, Fosamax has finally agreed to a confidential settlement agreement with Plaintiff Shirley Boles. Ms. Boles took Fosamax and suffered osteonecrosis of the jaw and was awarded $8 million in damages by a jury-which a judge reduced to $1.5 million. (Boles v. Merck & Co., Inc., 06 Civ. 9455 (JFK). Rather than accept the reduced award, Ms. Boles was preparing for another trial, however, Merck decided to settle confidentially rather than face another trial with potentially high damages.

The advisory panels will discuss whether women who take biophosphonate bone drugs should take a “drug holiday” due to increased concerns of the long-term use side effects and they will also review the medical evidence to date to determine whether biophosphonates have proven to be safe and effective in use longer than three to five years.
