Plavix Manufacturers Request Centralization of Federal Plavix Bleed Lawsuits

10/18/2012 - Although most Plavix bleed lawsuits are filed in state court, Defendants, Bristol-Myers Squibb Company and Sanofi-Aventis U.S., L.L.C. filed a motion to centralize the federal cases for a second time, reports Harris Martin.  [1].

In 2011, the Judicial Panel on Multidistrict Litigation (JPML) denied the defendants motion to centralize the Plavix lawsuits.  This time around Bristol-Meyers and Sanofi-Aventis noted that there was an increased number of Plavix lawsuits pending in state and federal courts.  Defendants went on to argue that although there were currently only  30 federal claims pending, that number would surely increase as thousands of new plaintiffs had filed claims in state and federal courts over the last few months.   Defendants allege that most of the current Plavix lawsuits are in the early stages of litigation and discovery is just beginning.

The consolidation and centralization of lawsuits allows for consistency in discovery rulings and avoids duplicative discovery.   Bristol-Meyers and Sanofi-Aventis recommended the cases be centralized in New York or New Jersey since they are headquartered there, have substantial business there and a majority of their witnesses are located there.

Plaintiffs in the lawsuits allege Defendants failed to warn of the potentially fatal bleed side effects and over-promoted the drug’s efficacy and health benefits.

Interestingly on August 8, 2012, the JPML ordered for centralization of federal Pradaxa bleed lawsuits before The Honorable David Herndon in the U.S. District Court for the Southern District of Illinois.  These lawsuits similarly allege the failure to warn of the potentially fatal bleeds.
