Stryker Rejuvenate Recall Lawsuits May be Consolidated before One Judge in New Jersey

- Ennis & Ennis News

10/31/2012 - On October 18, 2012, ten Plaintiffs who currently have Stryker Rejuvenate and/or  Stryker ABG II Modular Hip Stem lawsuits filed in New Jersey state courts filed an Application for Multi county Litigation. The establishment of the Multi county Litigation would allow Stryker Rejuvenate lawsuits and Stryker ABG II Modular Hip Stem lawsuits filed within various counties in New Jersey to be consolidated before one judge.  The consolidation of cases before one judge is common with product liability claims because it prevents duplicative discovery and inconsistent rulings and reduces costs.

According to the application, there are currently 10 claims filed in New Jersey, where manufacturer of Stryker hip implants, Howmedica Osteonics Corporation, is headquartered.  All ten of the subject lawsuits involve plaintiffs who had the Rejuvenate Stem implanted just within the past one to three years and had to undergo a revision surgery to have the device removed due to metallosis, necrosis and osteolysis.

In June 2008, the FDA issued clearance on the Stryker Rejuvenate Modular Stem for use in primary and revision total hip arthroplasty.

In November 2009, the FDA issued clearance on the Stryker ABG II Modular Hip Stem also for use in primary and revision total hip arthroplasty.

On July 3, 2012, Stryker Orthopaedics recalled its Stryker Rejuvenate and Stryker ABG II Modular Hip Stem due to the increased risk of fretting and/or corrosion, metallosis and failure of the device.

Remember the law limits the time in which you can file a claim, so don't wait to explore your legal rights.
