08/02/2012 - Claims of negligence and fraudulent marketing are being brought against Medline for selling counterfeit surgical mesh popularly used in hernia repairs. [1] So far 18 claims have been made where patients received the counterfeit product and had complications according to the Chicago Business Journal.
Medline began purchasing the mesh in 2008 from Ram Medical Inc. and the mesh was believed to be manufactured in Murray Hill, N.J. By C.R. Bard Inc., a very popular medical device manufacturer. However the mesh came from an outside company in India and was unsterile and had the potential to come un-raveled.
The charges of fraud and negligence arose in 2010 when the FDA began to investigate patient issues with the mesh. The company believes that the problem comes from the fact that the product gets to them indirectly and that they are a third party supplier and one of five that Ram Medical Inc. supplies the surgical mesh through.
The mesh was voluntarily recalled in 2010 by Ram Medical, however the number of people who received the counterfeit mesh is unknown. Ram Medical has plead guilty to criminal charges for this issue however Medline is still under fire for marketing this counterfeit mesh as the brand name and failing to properly monitor the product they were supplying.
