Montara woman sues drug company over birth control pills

03/18/2010 - A Montara woman has filed a lawsuit against Bayer Pharmaceuticals asserting it sold birth control pills that it knew were risky and that she suffered organ failure as a result of taking them.
Louise Thanos took Yasmin birth control pills, which are also called Yaz, from November 2007 to November 2009, but in March 2008 she had major health problems, including gallbladder failure, the lawsuit filed in San Mateo County Superior Court says.
Thanos, who is seeking unspecified damages, is one of hundreds of women around the country who have filed similar lawsuits. Many allege that Yasmin causes potentially life-threatening blood clots, though some note gallbladder problems as well.
The Bayer company, when contacted by the Times for comment, responded with a written statement that it is taking Thanos' lawsuit seriously and that its birth control pills are safe. Any complaints the company has received so far are the result of side effects that are disclosed in the drug's labeling, Bayer said.
"Bayer will defend itself vigorously against these lawsuits," the statement said.
Thanos' attorneys wrote in the lawsuit filed earlier this month that the drug is dangerous because it contains an insufficiently tested synthetic hormone called drospirenone.
They say the company knows or should know that the pills created a higher risk for strokes, heart attacks, deep vein thrombosis and liver and kidney disease for those who use them.
Bayer has already been warned by the Food and Drug Administration to make the risks of the pills clearer, the lawsuit says. In 2003, 2008 and 2009, the FDA told the company to not overstate the drug's efficacy and downplay the risks in advertisements. According to the lawsuit, Bayer was ordered to spend $20 million on ads that corrected the misleading commercials.
Bayer's behavior is "despicable and so contemptible that it would have been looked down upon and despised by ordinary people," the lawsuit says.
Thanos could not be reached for comment Wednesday afternoon.
One of Thanos' attorneys said she could not discuss the details of her client's reaction to the drug without Thanos' permission.
