Yaz revises ad campaign amidst lawsuits

04/14/2010 - In the wake of mounting lawsuits, Bayer Pharmaceuticals is issuing new warnings regarding its contraceptives called Yaz and Yasmin. The two birth control pills make big bucks for Bayer. The pharmaceutical giant racked up $1.3 billion from the drugs in the first three quarters of 2009 alone.

But 1,100 lawsuits have been filed by women who claim the drugs are dangerous and now the company is voluntarily issuing new warnings.

Indianapolis CFO Gina Miller is one of the women suing Bayer. The thirty-something wife and mother of three has always been an avid runner, logging up to 35 miles a week until she began taking Yaz.

"My running was a struggle. I was fatigued and short of breath. I just didn't feel like myself," Miller said.

She was diagnosed with multiple pulmonary embolisms or blood clots in the lungs. She's suing Bayer Pharmaceuticals, the maker of Yaz and Yasmin.

Indianapolis lawyer William Riley represents miller and 64 other women who he says suffered serious side effects from the drugs including stroke, pulmonary embolisms, gall bladder disease, and deep vein thrombosis.

Yasmin and Yaz are huge money-makers for Bayer with slick ads featuring attractive young women. But in wake of mounting lawsuits, the drug maker has chosen to provide information on the possible increased risk of blood clots in the contraceptives' warning inserts.

24-Hour News 8 obtained a letter from the FDA to Bayer Pharmaceuticals . It states that all promotional materials must be promptly revised to make it consistent with the new warnings. That means ads for the drugs will likely soon have a new feature, a disclaimer information about the possible of increased risk for blood clots.

But Riley believes that's not enough.

"I think the company needs to come clean with what they know and allow consumers to make an informed choice," said Riley.

You should start seeing the new warnings with Yaz and Yasmin in a couple of weeks. But don't expect a speedy resolution to the lawsuits. Plaintiffs' attorneys say it could take as long as five years for the matter to be resolved in court.
