Essure Advocates Host D.C. Rally To Support the Medical Device Safety Act of 2017
On September 25, 2017 advocates for changes in the laws pertaining to Class III medical devices will rally and lobby in Washington, D.C. in support of the Medical Device Safety Act. The rally is being hosted and sponsored by the Essure Problems Group along with the Breast Implant Victim Advocacy Group. All victims of Class III medical devices are strongly encouraged to attend the rally and to meet with Congressmen to effect the passage of this important bill. The Rally will take place on Capitol Hill Grounds at Constitution Avenue NE and 1st. Street. Wear red shirts to show solidarity and support for the bill and for victims harmed by Class III medical devices. There will be also be a Congressional press conference held during the Rally.
The Medical Device Safety Act, H.R. 2164 was introduced by Congressman Brain Fitzpatrick on April 26, 2017. It quickly became a bi-partisan bill being co-sponsored by Congresswomen Rosa DeLauro, Louise Slaughter and Jan Schakowsky. The bill seeks to amend the Food, Drug and Cosmetic Act to enable state law product liability actions by those injured by Class III medical devices against the manufacturers of these devices.
There are currently over 157 Class III medical devices on the market in the United States to which this law would apply. Manufacturers of these often dangerous devices currently enjoy near immunity from suit under a legal concept called federal preemption. Although this immunity is not absolute, the current laws make it extremely difficult for a party injured by a defective medical device to seek compensation from the manufacturer, even if the manufacturer knows of the defect and takes no action to correct it. Unfortunately in our society, it is often only the threat of civil litigation which prompts manufacturers to take the necessary action to ensure their products are safe.
