Essure Lawsuit Filings Against Bayer Level Off at Second Quarter Mark to 31,600

After several quarters of significant upswings in the number of Essure lawsuits filed against Bayer, this last quarter has shown a relatively small increase in filings. According to Bayer's Quarterly Report, as of July 11, 2019  approximately 31,600 lawsuits have been filed by Essure victims, up from 31,000 noted on April 11, 2019. Plaintiffs allege personal injuries from the use of Essure, including hysterectomy, perforation, pain, bleeding, weight gain, nickel sensitivity, depression and unwanted pregnancy, and seek compensatory and punitive damages.  Women who were injured by Essure and who have not yet filed their claims, are urged to do so quickly as various time limitations are applicable. The first Essure cases are scheduled to be tried in January 2020, having been continued from November, 2019. Many other Essure cases are set for trial in the Spring and Summer of 2020 and preparation for trials is being feverishy undertaken.

This would not have occurred without the tireless efforts of thousands of women from the group. 

Essure lawsuits have been filed throughout the country. There are over 27,000 cases pending in California. There are also nearly four thousand lawsuits pending between Philadelphia, St. Louis, Illinois, Pittsburg and Indianapolis. Most cases are currently in the discovery phase of the litigation with plaintiffs filling out Plaintiff Fact Sheets. Plaintiffs’ counsel is focused on reviewing documents produced by Bayer and taking depositions of key Bayer personnel, despite Bayer’s attempts to stall and delay at every opportunity. Essure has now been discontinued or withdrawn world-wide
