Essure Lawsuits Increase To 33,100
Bayer's First Quarter Report released last week shows that Essure lawsuits continue to be filed, although at a much slower rate than previous years. According to the most recent report as of February 6, 2020, there were 33,100 lawsuits filed. We last reported the Essure filings in July, 2019 where there were approximately 31,600 lawsuits filed by Essure victims, up from 31,000 noted on April 11, 2019. Plaintiffs allege personal injuries from the use of Essure, including hysterectomy, perforation, pain, bleeding, weight gain, nickel sensitivity, depression and unwanted pregnancy, and seek compensatory and punitive damages. Women who were injured by Essure and who have not yet filed their claims, are urged to do so quickly as various time limitations are applicable. The first Essure cases are coming up for trial and we can expect to see several Essure cases tried this summer.
Ennis & Ennis, P.A. and co-counsel have filed Essure lawsuits, representing thousands of plaintiffs nationwide against pharmaceutical giant, Bayer and several related subsidiaries. The significant complications suffered by these plaintiffs include migration, hysterectomy, abdominal pain, pelvic pain, back pain, bloating, weight gain, mental haziness, heavy menstrual bleeding, irregular menstrual cycles, perforated organs, autoimmune issues, hair loss, tooth loss, headaches, pregnancy and other complications.
Holly Ennis, one of the attorneys filing the complaints stated, “We continue to file lawsuits for every woman injured by Essure to be compensated by Bayer. We also seek legislative changes through the Medical Device Safety Act. Everyone should contact their Congressmen and urge them to supoort and pass this vital legislation." Through the advocacy work of the Essure Problems Group, Bayer finally ceased sales of Essure effective 12/31/2018 and no Essure devices could be implanted worldwide after 12/31/2019. This would not have occurred without the tireless efforts of thousands of women from the group.
Essure lawsuits have been filed throughout the country. There are over 27,000 cases pending in California. There are also nearly four thousand lawsuits pending between Philadelphia, St. Louis, Illinois, Pittsburg and Indianapolis. Most cases are currently in the discovery phase of the litigation with plaintiffs filling out Plaintiff Fact Sheets. Plaintiffs’ counsel is focused on reviewing documents produced by Bayer and taking depositions of key Bayer personnel, despite Bayer’s attempts to stall and delay at every opportunity.
We continue to represent women in all 50 states who have been injured by the Essure device. If you or a loved one have questions regarding Essure, contact Holly Ennis at 1-800-856-6405, Holly@Ennislaw.com or visit us online at www.Ennislaw.com for a free consultation.
