Essure Women Should Retain Attorneys Now To Protect Their Rights

Women who are considering filing a claim for an Essure-related injury should act swiftly in retaining an attorney to ensure their rights are protected. It is particularly urgent for women who have undergone removal surgery prior to September 24, 2015 to retain counsel immediately as your statute of limitations or time frame in which to file a lawsuit will likely expire on September 24, 2017.  At least one Judge in California, where the majority of the Essure claims will likely be filed, has made a tentative ruling indicating the statute of limitations period likely began to start running as of the September 24, 2015 FDA hearing. Accordingly, women whose removal surgeries occurred prior to this time are particularly vulnerable to being barred by the statute of limitations periods if their claims are not filed prior to September 24, 2017 and must seek counsel immediately. 

Significant progress has been made in the various pending Essure lawsuits filed across the country and the cases are moving forward.    Many women have questioned whether their Essure device has to be removed in order to file a claim. Any women who has the device and has suffered an injury may file a claim, regardless of whether she has had the device removed.  Different factors will go into the determination of the amount of compensation a women may be entitled to, however, removal is not a prerequisite to filing a claim.  There are many types of injuries related to the Essure device and they may compensated accordingly.
